However, according to the 2019 amendment in the MCS Act 1960 for associate member who has no rights in property but can still contest such nomination can't be done by him.Thanks. Nominees will not get transfer of membership and /or the share / interest in the property of the deceased member.He / She does not become next member on such nomination after member's death. As there is no transfer of membership and share/interest in the flat (property) by way of nomination then mentioning of share percentage is also has no meaning.The member can not nominate anybody in fraction / percentage. Fraction/Percentage is only among the available legal Heirs and not among the Nominees. If a nominee is a joint member then also the share of the deceased will be shared by legal heirs of the deceased member and does not automatically transfer to the Nominee.
