February 28, 2017 3800 Highland Ave. City Heights, San Diego Man pulled over, given physical field sobriety test, which he appeared to pass, Officers asked him to perform a Breathalyzer test, which is completely optional. I tried letting him know by shaking my head No to him, however he still consented to the test, which came back as over the legal limit. He was then arrested. He may have very well avoided arrest if he would've known and exercised his rights.
