The Hon’ble Supreme Supreme Court has held that any act of viewing, distributing of any child pornographic material by a person over internet without any actual or physical possession of such material in device would also amount to possession in terms of section 15 of POCSO Act, 2012, provided the person exercised an invariable degree of control over such material, by virtue of doctrine of constructive possession.
