UK Immigration Amnesty - the facts and the fiction - truth and lies

"The 10 year Rule is back" These are some of the lies that I have found on a text message that I was able to convert to a pdf. It has been circulated to many people, indeed one of my vulnerable clients got it. It is completely untrue - while the government may and this is a huge may and reflects the PMs previous words, Brexit, 30 June 2021 deadline and EU obligations may introduce a scheme to regularise people - this is pure speculation - there is no hard and fast evidence to support it. I have spent a lot of time looking for evidence for where this comes from - and I can only assume that someone who is either malicious or someone who is on the fringes of immigration law has created it either to generate work or to give false hope. I say generate work as I have had many people come to me that say that they have been introduced to friends who have made applications for them - these friends tend not to be lawyers. Also I find clients coming to me who have paid for Certificate of Sponsorship for jobs that do not and never have existed. This used to occur more frequently with students but does not so much. This is a crime. Section 84 of the Immigration and Asylum Act 1999 prevents selected individuals such as barristers and solicitors to provide immigration advice, to do so if you do not fall within s.84 is a crime. I have been doing immigration since 1999 and remember that before the 1999 Act anyone and I mean anyone could set themselves up as immigration consultants. Some of the work was appalling. Unfortunately, the position has not changed completely while there are some good OISC and charity workers in the field of immigration I have met lawyers who cannot speak English. Forgive my passion in this regard, but this amnesty that is being touted is the biggest fraud being pushed in any area of law where there are more frauds that any other I have found. The quality of Immigration Representatives varies with the size of fish, there are those in tanks and those 20 metres long. There seems to be no control over the quality of the work. However, it is this rumour that has lead me to make a number of videos. I received, I think I had recently seen the forwarded message, relating to the "10 year Amnesty" - however this arrived in the phone of someone who is desperate to remain in the UK and is therefore vulnerable to such messages. I say this as it is known that there is corruption within the HO, they have their own unit to try and stamp it out, so it can appear superficially attractive to someone vulnerable, if approached, with a "cast iron" promise that if they pay over a huge sum of money they will get status. I have seen this happen. I have also seen what happens when the HO fraud department catch someone - they then are able to work out who that person "granted ILR" to and then the HO waits for the person to surface... The purpose, in part of this video is to highlight that you should not believe everything that you read - especially in this area of law. While the HO may well recognise that there is a need to try to regularise whoever is in the UK, both EU and non EU at some point is a matter for discussion and nothing more. I would not advise anyone to "hold their breath" and wait for the great announcement.
