The indictment that Donald Trump recently got, of course, from, uh, Jack Smith regarding his attempts to overturn the results of the 2020 election mentioned something that previously had been unknown and that previously unknown something was the existence of a memo written on December 6th, 2020. By then Trump lawyer, Kenneth Chesbro, and the contents of that memo had not been made fully public by the indictment. But now the New York Times has of course, obtained this information and we now know full well about this massive piece of evidence that if you're gonna call it a smoking gun, I don't think that's a, you know, overstatement, but it lays out exactly the plan that they had to do exactly what Donald Trump was just indicted for, commit fraud against the government by sending an alternate slate of electors by claiming fraud that didn't exist and interfering with an official act of Congress by trying to delay the certification of the electoral college votes. Let me read you this from the New York Times, while the basic plan itself was already known, the document described by prosecutors as the fraudulent elector memo provides new details about how it originated and was discussed behind the scenes among those details. As Mr. Chesbro proposed messaging strategy to explain why pro-Trump electors were meeting in states where Mr. Biden was declared the winner. The campaign would present that step as a routine measure that is necessary to ensure that the correct electoral college electoral slate could be counted by Congress if courts or legislatures later concluded that Mr. Trump had already won the states. In the memo, Mr. Chesbro says, I recognize that what I suggest is bold, controversial strategy, and that there are many reasons why it might not end up being executed on January 6th, but as long as it is one possible option to preserve it as a possibility, it is important that the Trump Pence electors cast their electoral votes on December 14th. I believe that what can be achieved on January 6th is not simply to keep Biden below 270 electoral votes. It seems feasible that the vote count can be conducted so that at no point will Trump be behind in the electoral vote count unless and until Biden can obtain a favorable decision from the Supreme Court upholding the Electoral Count Act as constitutional or otherwise recognizing the power of Congress and not the President of the Senate to count the votes. That's just a snippet, okay? That's, that's not the full plan. He actually goes into the actual explicit details as well, but I'm not gonna read the whole thing for you. Um, but again, if you are gonna call anything in this indictment, a smoking gun, this is it. This proves everything that Trump's lawyers have been claiming for the last week Is completely untrue. This is not a matter of a First Amendment right. Trump has the right to go out and say all these lies about the election. He absolutely does. Unfortunately, what he does not have the right to do is actually hatch a scheme. This memo was of course, presented to members of the Trump administration and members of the Trump legal team, including Rudy Giuliani, and, uh, it appears John Eastman as well. Chesbro is believed to be, uh, co-conspirator number five in the indictment. And this, this memo was shown to other, uh, potential co-conspirators in addition to Giuliani and Eastman.
