You ask the doctor for your records. The doctor's office says you must put it in writing. You give the doctor's office written permission to release copies of your records. Yet still, they refuse to turn your medical records over to you. Or, they simply ignore your request for weeks and months. What do you do in that case? By law, you are entitled to obtain copies of your medical records. You will not be able to obtain the original records, only copies. The doctor's office can only release copies of your records if you provide them with written permission to do so. Then, the office will request copying costs from you. Once you pay the copying costs, they should readily turn over copies of your records. There are many instances where we are evaluating a medical malpractice case, and the doctor's office refuses to timely turn over your records. If that happens to you, what can you do to get your records? The simple answer is to send a copy of the documents you provided to the doctor's office and put them in a letter addressed to the New York State Department of Health. Simply explain that you made a proper and timely request for copies of your records and that the doctor's office is refusing to turn over your medical records. That will prompt an inquiry by the NYS Department of Health to the doctor's office. That should immediately prompt the physician's office to send those records out immediately in order to prevent further investigation by the Department of Health. Watch the video to learn more...
